DGAC helicopter rules during flight operation
OPS 3.003 Terminology
(a) Terms used in this document have the following meanings:
(1) Authority: means the Minister responsible for civil aviation or
other authority or service competent.
(2) Date of issuance of the first individual certificate of airworthiness (or
type): Unless otherwise specified, the date of first issue of a certificate
individual airworthiness (or type) the helicopter (or type) in question, anywhere in the world.
(3) Community operator: operator having its registered office or its principal place of business territory of the Member States of the European Community, of the States parties to the Agreement on the European European Economic, or Swiss Confederation and holding a Air Operator Certificate accordance with Regulation (C.E.E)
No 2407/92 of the Council of 23 July 1992 on licensing of Air carriers.
(4) Heliport: airfield area defined on the ground or water, or structure used or intended for use in whole or in part for arrival, departure and movement surface helicopters. It can therefore be either an aerodrome primarily for aircraft fixed wing, as appropriate to spaces reserved or designated purpose or a helipad (airfield equipped for
only helicopters) or a helipad (slot located outside of airfields), both possibly being located on land or at sea.
(5) Final Approach and Area off (FATO) area defined above which runs Phase final approach maneuver to stationary or until landing and from which starts the take-off maneuver and that, when the FATO is intended to
be used by helicopters Performance Class 1, includes the take-off area usable.

lowering minimum operational. (See IEM to OPS 3.003 (9))
(10) Flight S.M.U.H. special. flight S.M.U.H requiring lowering
operating minima, and wherein additional requirements are applied.
(11) Hostile environment.
(i) An environment in wherein:
(A) a forced landing Security can not be accomplished because the surface is not adequate,
(B) or the occupants of the helicopter can be adequately protected natural elements,
(C) or the response time or research capacity and rescue is not appropriate time of deadlock, the engine failure expected
(D) or there is endangered persons or unacceptable ground property.
(ii) In all cases, the areas following should be considered as hostile:
(A) for the over water, the maritime areas north of latitude 45N or South of 45S designated parallel by the State Authority concerned;

(12) non-hostile environment.

(15) Crew composition:

(16) Member Functions Crew:
(i) The function "Command" includes taking all decisions necessary for the execution of the Mission and tasks
provided for by the aviation civil code .
(ii) The "Steering" includes tasks for maneuver the helicopter flight conditions to visual or instrument (VMC
or BMI) to follow the trajectory desired and especially maneuvers takeoff, in way and landing.
(iii) The "Mechanics" include tasks possible to ensure the ground and flight:
(A) checking airworthiness of the helicopter and its equipment, particularly after the interventions performed call;
(B) the implementation and monitoring of motors, systems and devices specific to the helicopter;
(C) the performance of special maneuvers of rescue or emergency deal with failures engine operation, Systems and devices specific to the helicopter;
(D) the establishment of the account of the state technique of the helicopter.
(iv) The "Navigation" includes all tasks to determine:
(A) the basic elements (cap, drift, ground speed, wind);
(B) position geographic the helicopter;
(C) follow the road provided, and the holding the helicopter on the road with a lateral deviation and Compatible longitudinal gap with the standards.
(v) The function "Telecommunications" includes all tasks for ensuring communications radio with airfields centers

(vi) The "Security- Rescue "includes all
tasks related to monitoring and the protection of passengers to the helicopter when last is in flight, as well as soil
when starting operations, arrival or when required by regulations. this function includes:
(A) the application of safety instructions, including controls under these regulations;
(B) monitoring the cab and its Annexes, and fight against fire;
(C) first aid to sick or injured passengers;
(D) the protection of cabin and passengers in the event emergency, including organizing the evacuation emergency.
(17) Driver captain in supervision:
Co-pilot who performed all duties and functions of a captain during a flight, such that no intervention of the pilot in command board was required.
(18) Synthetic flight Coaches:
All synthetic training devices flight (STD) such as simulators flight (FS), drive systems theft (FTD) or systems
Training flight procedure and navigation (FNPT), which replace helicopter in during training or controls under this Annex must be qualified by the Authority or by a qualified authority foreign in conditions acceptable to the Authority, and employment must be approved by the Authority for the exercises carry out.
SUBPART B - GENERAL
Each helicopter is to be operated accordance with the terms of its certificate airworthiness and within the specified limits in its flight manual. (See Appendix 1 to in OPS 3.005 (c))
(d) medical service operations Emergency helicopter (S.M.U.H.) must be conducted in accordance with
special provisions of Appendix 1 in paragraph 3.005 (d). To perform such operations, the operator must hold a permit specific. This authorization is called "S.M.U.H authorization."
(e) The provisions specific to helicopter operations over a hostile environment located outside the area
inhabited are laid down in Appendix 1 section 3005 (e). To conduct a flight in accordance with these
provisions, the operator must hold a specific authorization. this authorization is called "environmental authorization hostile located in a hostile zone located outside the area inhabited. "
This appendix does not apply to flights S.M.U.H. Special made in accordance with the requirements of Appendix 1 to OPS 3.005 (d).
(f) The provisions specific to helicopter operations whose mass maximum certificated take-off (MCTOM) is less than or equal to 3175 kg, the maximum approved Passenger seats (cmasp / MAPSC) is less than or equal to 9, and on the day of navigable routes to visual landmarks are set by Appendix 1 paragraph 3005 (f).
To conduct a flight in accordance with these provisions, the operator must hold a
specific authorization. this authorization is called "authorization small Operations VFR helicopter day only. "
(g) Specific provisions for helicopter operations, the mass maximum certificated take-off (MCTOM) is greater than or equal to 3175 kg and whose maximum approved Passenger seats (cmasp / MAPSC) is less than or equal to 9, which consist of near circular flights are set by Appendix 1 paragraph 3.005 (g).
To conduct a flight in accordance with these provisions, the operator must hold a specific authorization. this authorization is called "authorization wholesale operation Helicopter flights at near circular day VFR only ".
(h) The hoist operations (H.H.O.) must be made accordance with Special Appendix 1 paragraph 3005 (h).
To conduct a flight in accordance with these special provisions, the operator must hold a specific authorization. this authorization is called "authorization H.H.O. ".dropoff Window
(i) Specific provisions for helicopter operations to or from a public interest site are set by Appendix 1 paragraph 3.005 (i). To perform such operations, the operator must hold a permit specific. This authorization is called
"Exploitation authorized sites public interest. "

OPS 3.020 Laws, Regulations and Procedures - Operator's Responsibilities.
(a) An operator shall ensure that:
(1) all employees are informed that they must comply with the
laws, regulations and procedures States in which operations are conducted and which relate to the performance of their duties;
(2) and that all members of the crew have a good knowledge of the laws, regulations and procedures the performance of their tasks.
OPS 3.025 Common Language
(a) An operator shall ensure that all Crew members can communicate without problems in a same language.
(b) An operator shall ensure that all operating personnel may include the language are written parts of the Operations Manual pertain to their duties and responsibilities.
OPS 3.030 Minimum Lists equipment - Responsibilities operator
(a) An operator shall establish, for each helicopter a minimum list equipment (L.M.E.), approved by the Authority. This should be based on, but no less restrictive than, the minimum list reference equipment (L.M.E.R.)
(if this exists).
The conditions of establishment and the acceptance procedures and approvals of L.ME.R. and L.M.E. specified
by order of the Minister of Aviation civil.
(b) An operator shall operate a Helicopter than in accordance with L.M.E. unless approved by the Authority.
Such permission will in no circumstances permit operation outside restrictions L.M.E.R.
OPS 3.035 Quality System (See AMC OPS 3.035 and IEM OPS 3.035)
(a) An operator shall establish a system quality and designate a quality manager to monitor compliance with, and
the adequacy of, procedures required to ensure safe operational practices and airworthiness of helicopters. this control
The operator must ensure that essential information relevant to the flight concerning services
Search and Rescue is easily accessible to the cockpit.
OPS 3.055 Program information safety equipment and rescue embedded
The operator must ensure that are available for communication the immediate coordination centers rescues, lists containing
Emergency medical equipment, water supplies and the type and frequencies of the portable radio equipment help.

OPS 3.065 Carriage of weapons of war and munitions of war
(See IEM OPS 3.065)
(a) An operator shall not transport weapons of war and munitions of war if there has been authorized by all states
concerned.
(b) An operator must ensure that weapons and munitions of war are:
(1) Stowed in the helicopter in a inaccessible to passengers
during flight;
(2) and discharged in the case of Firearms unless, before the theft, all the States concerned have given
approval for said weapons of war and munitions of war can be transported in wholly or circumstances partially different from .
must have a system of return information to the Accountable Manager (see also OPS 3175 (h)) to ensure taking measurements necessary corrective.
(b) The quality system must include a quality assurance program containing procedures designed to verify that
all operations are performed in accordance with all the requirements, standards and procedures.
(c) The Quality System, and the quality must be acceptable the Authority.
(d) The quality system must be described in documentation.
(e) Notwithstanding under sentences
(a) above, the Authority may accept the nomination of two Quality Managers, one for operations and for the maintenance, provided that the operator has designated one unit quality management to ensure that the quality system is applied uniformly throughout exploitation.
OPS 3.037 Prevention Program accident and flight safety (See IEM OPS 3.037)
An operator shall establish a program accident prevention and safety flights, which comprises:
(1) a system for collecting and analyzing rendered accounts of incidents,
(2) a program to ensure and maintain awareness of the risk of all concerned by operations. This program must
including ensuring internal diffusion the results of analyzes carried out by the previous system, which must be taken into account the quality system.
OPS 3.040 Crew additional
The operator must ensure that the crew members other than members of the flight crew or required cabin, have also been trained,
specified in this sub paragraph.

OPS 3.070 Carriage of weapons and sporting ammunition
(See IEM OPS 3.070)
(a) An operator shall take all reasonable steps to ensure that any sporting weapons intended to be transported by air are reported to him.
(b) The operator accepting the carriage sporting weapons shall ensure that:
(1) they are secured in the helicopter in a place inaccessible to passengers during flight unless the Authority has
considered that this was impossible and has accepted that other procedures are applied;
(2) and that in the case of firearms, or other weapons that can contain ammunition, they are discharged.
(c) Ammunition for sporting weapons can be transported in luggage registered passengers, subject to certain limitations, in accordance with the Technical Instructions (see OPS 3.1160 (b) (5) as defined in paragraph OPS 3.1150 (a) (14)).
OPS 3.075 Method of carriage of people
(a) An operator shall take all measures reasonable to ensure that no one in any part of either a helicopter flight, which was not designed to receive persons except in case the commander has authorized temporary access to any part of the helicopter:
(1) to perform an action necessary for the safety of the helicopter or any person, animal or goods therein;
(2) are transported or in which freight or cargo, said portion being adapted to allow a person to have access thereto while the helicopter is in flight.
OPS 3.080 Introduction dangerous Goods for the transport air
The operator shall take all measures reasonable to ensure that no present or accept goods hazardous for air transport, unless he has received training and the goods are properly classified, documented, certificated, described, packaged, marked, labeled and ready for transport accordance with the Instructions
Techniques.
OPS 3.085 Responsibilities crew
(a) A crew member is responsible for the proper performance of its tasks:
(1) related to the safety of the helicopter and its occupants;
(2) specified in the instruction and procedures described in the manual operating.
(b) A crew member shall:
(1) report to the commander edge of any incident that has or could able to question the security; and
(2) to use the account system

(c) A crew member shall not perform duties on a helicopter:
(1) While under the influence of medicines / drugs / alcohol risk affect his faculties in a manner contrary security;

(e) In accordance with Articles L.422-2, L.422-3 and L.422-4 of the aviation code Civil,
the captain:

(2) have authority to give all orders it deems necessary to ensure the safety of the helicopter and transported persons or property;
(3) have authority to disembark any person, or any part of loading, which it believes it can constitute a potential risk to safety or the safety of the helicopter or its occupants;

(10) must decide whether to accept a helicopter having non-operations allowed by the list deviations from the
configuration type (CDL) / list Minimum Equipment (L.M.E.)

OPS 3.090 Authority of the commander edge
The operator shall take all measures reasonable to ensure that all persons on board

OPS 3.100 Access to cockpit
(a) An operator shall ensure that no person other than a crew member

(2) a representative of the Authority responsible for certification and approvals, licensing or inspection, if this is necessary for the performance of his official duties;
(3) or allowed and transported accordance with the instruction

(b) The commander must ensure that:
(1) in the interest of safety, cockpit admission does not cause distraction or interfere with the flight;
(2) and all persons carried in the cockpit are familiar with the procedures applicable safety.
