 Vienna is one of the main Austrian construction groups. Net sales break down by activity as follows. Building construction (65.6%): residential buildings, office buildings, shopping centers, public buildings, etc. Activity is provided in Austria-Switzerland-Czech Republic (74.7% of sales) and in Germany (25.3%);
Construction of civil engineering infrastructure (29%): bridges, tunnels, railways, roads, highways, power plants, etc. The activity is mainly carried out in Poland, Scandinavia, Qatar, Slovakia, Romania, Bulgaria and the United Kingdom;

Environmental engineering services (4.3%): development and operation of landfills and waste treatment units, transport and recycling services for demolition rubble and construction waste, services sanitation, etc. In addition, the group is developing a construction activity for healthcare establishments; Other (1.1%), in particular the provision of engineering services.

Net sales are distributed geographically as follows: Austria-Switzerland-Czech Republic (49%), Germany (16.6%) and others (34.4%).

Vienna is the owner of the constructors Munster in Germany and Hertogenbosch in the Netherlands. In 2019, investigations by Austrian anti-corruption prosecutors led to searches of Vienna Corps for legal sanctions of up to tens of millions of euros.

The local anticorruption financial prosecution was accused of about twenty construction companies for having concluded illegal price agreements for more than ten years with irregularities found in more than 100 road construction contracts. Projects with legal problems include repairs to the Pyhrn A9² road, the Karawanken A11² road, the B66 national road, the L117 regional road (Land) east of Steietmark Land and the L502 regional road between St. Lambrecht and Murau, in Steiermark. Major rail projects are also targeted by the Austrian authorities, such as the Koralm line² or the extension of the south line.

About fifteen companies were searched this year. An employee had been the subject of a guilty plea in the past for similar acts.

“ The accusation rests mainly on the valuation of documents contained in a supplier file of Kostmann GmbH. Based on this data, we can consider that the agreements between the companies involved in the tenders can be examined using the documents contained in these files " said the prosecutor, quoted by the Viennese media².

In the past, the Federal Competition Authority² has estimated that there have been non-competitive cost agreements not for 350, but for no less than 800 projects.

The competent court for this agreement is the Superior Court of Wien². The highest individual penalty in the history of price agreements is that of 40 million euros applied to the supermarket chain Spar. The total sanctions of the cartel amounted to 75 million euros in 2009. The investigation itself is divided between the BWB and the Economic and Corruption Prosecutor's Office (WKStA)

Between 2006 and 2018, the companies concerned would have agreed on prices and shared customers and regions. Said price agreements and awarding of contracts contributes to the inflation of the value of the services which could be perceived as prejudicial by the prosecution.

And 2001, a German subsidiary excepted a legal agreement for facts assimilated to collusion. The principle of the right to be forgotten allows them today to claim that it is eligible for tenders in the USA with an incentive rate of confidence. Nevertheless, the principle of dissemination of the fault in the event of legal proceedings by the Wien prosecutor's office could constitute, in the eyes of the FCPA² judge, a reiteration or an aggravating circumstance. This fact comes into consideration in its legal assessment even though the solvency of Vienna would allow it to pay a fine or through, not without difficulty, a conviction in Europe. As such, calls for tenders transiting through Vienna have an upper medium rating level.
